License terms

The terms you accept when you install Keepwell. The setup program shows the same text.

Draft for the beta. These terms will be reviewed and may change before Keepwell goes on sale.

These terms are an agreement between you and Kernel, LLC ("we", "us"), the publisher of Keepwell ("the software"). By installing or using the software you accept them. If you don't accept them, don't install the software.

1. What you may do

  • Free trial: you may use the software on one computer for 14 days to decide whether to buy it.
  • Home edition: you may use the software on the number of computers your license is for (1 or 3), for yourself and your household. Updates within version 1 are included.
  • Business edition: you may use the software on the number of computers your subscription is for, for as long as the subscription runs, within your organization.
  • You may remove the software from one computer and use the license on another.

2. What you may not do

  • Share your license key or account with people outside what your license covers, or sell or rent the software.
  • Work around the license checks, or reverse engineer the software, except where the law allows it regardless of these terms.

3. What the software does to your drives

The software mainly reads: it checks the health of your drives. It writes only for features you can see and control: copies of your folders made by File protection, files rescued or recovered to another drive, the optional write test, and moving files off damaged parts of a drive (which you can turn off). It never repairs, formats or partitions a drive. Read the explanations on screen before using these features.

4. No guarantee that drives won't fail

Drives can fail suddenly and without any warning sign. The software can't predict every failure, and can't guarantee to protect, copy or recover every file. Always keep a separate backup of anything important, on another device or in the cloud.

5. Warranty

The software is provided "as is". To the extent the law allows, we give no warranties beyond those in these terms, including any warranty that it is free of errors or fit for a particular purpose. If you are a consumer, you keep the rights consumer law gives you; nothing in these terms takes them away.

6. Liability

To the extent the law allows, we are not liable for lost data, lost profits, or indirect or consequential damage, and our total liability is limited to the amount you paid for the software in the 12 months before the claim. These limits don't apply where the law doesn't allow them, for example for death or personal injury caused by negligence, or fraud.

7. Internet connection and your information

To check your license, the software sends our license server your license key, a fingerprint of your computer (a code that doesn't identify you), your computer's name and the software's version; the server also sees your internet address. If you create an account, we keep your email address and a protected form of your password. If you turn on email alerts, the alerts describe your computer and drives. Once a day the software asks our server whether a newer version is available, sending only its version. The software never sends your files, file names or file contents. Our privacy policy explains how we handle this information.

8. Ending

The free trial ends after 14 days. A subscription ends at the end of its term unless renewed. If you break these terms, your right to use the software ends. Copies of your files that the software made stay yours.
